These Terms have been adapted from Automattic, who graciously made their terms of service available under a Creative Commons Sharealike license. We extend our gratitude to Automattic for their generosity. You can obtain a copy of Automattic’s Terms and other legal documents on GitHub. These Terms are also accessible under the Creative Commons Sharealike license, permitting you to replicate, adapt, and repurpose them for your own use. However, please ensure that your Terms of Service align with your specific practices. Terms of Service

 

These Terms govern your usage of the products and services we provide through or for Storyworthy.com and all associated subdomains and related services (collectively referred to as “Services”). For certain additional or distinct terms, such as those applicable to the Storyworthy Community, please refer to specific terms that may apply. Before accessing or utilizing our Services, carefully review these Terms. By accessing or using any part of our Services, you signify your acceptance of all the Terms and other operational guidelines, policies, and procedures that may be published via the Services from time to time (collectively, the “Agreement”). You also acknowledge that we reserve the right to modify, update, or supplement our Services, and this Agreement will apply to any such changes.

 

1. Who’s Who

 

“You” denotes any individual or entity utilizing our Services. If you employ our Services on behalf of another individual or entity, you affirm that you are authorized to accept the Agreement on their behalf. By using our Services, you acknowledge your acceptance of the Agreement on behalf of that individual or entity. Furthermore, you and the represented individual or entity agree to be accountable to us in the event of any violation of the Agreement.

 

Throughout these Terms, we refer to Storyworthy LLC collectively as “Storyworthy” or “we.”

 

2. Your Account

 

In instances where the use of our Services necessitates an account, you consent to providing us with complete and accurate information and committing to keeping this information current to facilitate communication regarding your account. We may need to correspond with you via email concerning significant updates (e.g., modifications to our Terms of Service or Privacy Policy), or to notify you of legal inquiries or complaints received regarding your usage of our Services. We retain the right to limit your access to our Services until we verify your account details, such as your email address. When you establish an account on Storyworthy.com, we interpret this as an expression of interest in our products and services, permitting us to contact you to provide further information about our offerings (e.g., marketing). Rest assured, if you are uninterested, you can opt out of receiving marketing communications, whether through email, phone calls, or text messages. You are solely responsible and liable for all activities conducted under your account, including maintaining the security of your account (including safeguarding your password). We shall not be held liable for any acts or omissions on your part, including any resulting damages. Do not share or misuse your access credentials, and promptly notify us of any unauthorized usage of your account or any security breaches. In cases where we suspect compromise of your account, we may suspend or deactivate it. Storyworthy will exert commercially reasonable efforts to prevent unauthorized access to our data and files; however, no system, whether password protected or not, can be entirely impervious. You acknowledge the possibility of unauthorized third-party access to, viewing, copying, modifying, or distributing the data and files you store using our Services. 3. Minimum Age Requirements

 

Our Services are not intended for children. If you are under the age of 13 (or 16 in Europe), you are prohibited from accessing or using our Services. By registering as a user or utilizing our Services, you affirm that you are at least 13 years of age (or 16 in Europe). You may only use our Services if you have the legal capacity to enter into a binding contract with us. Storyworthy is committed to safeguarding your personally identifying information and will not deliberately disclose such information to third parties except as necessary to provide the Services or as required by law. By utilizing the Site, you signify your acceptance of Storyworthy’s Privacy Policy. If you disagree with this Privacy Policy in whole or in part, kindly refrain from using this Site.

 

5. Responsibility of Visitors and Users

We have not undertaken a comprehensive review of all the content (such as text, photos, videos, audio, code, software, items for sale, and other materials) posted to or made accessible through our Services by users or other individuals (“Content”), or on websites linked to or from our Services. We disclaim responsibility for any use or consequences of Content or third-party websites. Therefore:

We do not endorse any Content or assert that it is accurate, helpful, or harmless. Content may be offensive, indecent, objectionable, contain technical inaccuracies, typographical errors, or other mistakes, or infringe upon the privacy, publicity rights, intellectual property rights, or other proprietary rights of third parties.

We are not liable for any harm resulting from anyone’s access, use, purchase, or download of Content, or for any harm resulting from third-party websites. It is your responsibility to take necessary precautions to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content.

6. Fees, Payment, and Renewal

1. Fees for Paid Services: Certain Services are offered for a fee, such as the Storyworthy Academy Membership (referred to collectively as “Paid Services”). By utilizing a Paid Service, you agree to pay the specified fees. These fees may be one-time or recurring. For recurring fees, we will bill or charge you at the interval you select (such as monthly or annually) on a pre-pay basis until you cancel. You can cancel at any time through the Billing Info section of your Account or by contacting support.
   
   
2. Taxes: Unless otherwise stated, all fees exclude applicable taxes. You are responsible for paying all relevant taxes related to your use of our Services, payments, or purchases. If we are obligated to pay or collect taxes on the fees you have paid or will pay, you are responsible for those taxes, and we may collect payment.
   
   
3. Payment: Failure of payment, unpaid or untimely payments, or suspected fraudulent activity may result in immediate cancellation or revocation of your access to Paid Services without prior notice.
   
   
4. Automatic Renewal: Recurring Paid Services are automatically renewed to ensure uninterrupted service. By default, your Paid Services will be renewed for the same interval as your original subscription period. We may charge your account up to one month before the end of the subscription period to prevent any disruptions in service.
   
   
5. Canceling Automatic Renewal: You can manage and cancel your Paid Services through the Billing Info page. If assistance is needed, please visit our Support page or contact us via email.
   
   
6. Fees and Changes: We reserve the right to modify our fees at any time in accordance with these Terms and applicable legal requirements. If you disagree with the changes, you must cancel your Paid Service. Refunds are subject to our 30-day refund policy for Storyworthy Academy memberships and applicable law. In all other cases, payments are final and non-refundable.

7. Feedback

We highly value your feedback and are committed to continuously enhancing our Services. By sharing comments, ideas, or feedback with us, you agree that we may utilize them without restriction or compensation to you.

 

8. General Representation and Warranty

Our objective is to empower storytellers to achieve their objectives, and our Services are crafted to offer valuable resources and platforms for expressing yourself freely. While using our Services, you agree to the following:

 

• Your use of our Services will adhere strictly to the Agreement.
• You will comply with all applicable laws and regulations, including those governing online conduct, acceptable content, privacy, data protection, financial services, and consumer protection.
• You will refrain from engaging in unlawful activities or publishing illegal content.
• You will not infringe upon or misappropriate the intellectual property rights of Storyworthy or any third party.
• You will not unduly burden or disrupt our systems or infrastructure.
• You will not disclose the personal information of others.
• You will not utilize our Services for sending spam or bulk unsolicited messages.
• You will not interfere with, disrupt, or attack any service or network.
• You will not create, distribute, or enable material that contains or operates in conjunction with malware, spyware, adware, or other malicious programs or code.
• You will not attempt to derive the source code for our Services or any related technology that is not open source.
• You will not rent, lease, loan, sell, or resell our Services or related data without our consent.

 

9. Specific Service Terms

1. Storyworthy.com Website and Accounts: The Storyworthy.com website enables you to access online courses, download workbooks and exercises, participate in surveys, and engage in discussions. Your use of the Storyworthy services and website is also subject to the terms of Kajabi, LLC, which provides the platform for Storyworthy. Kindly review Kajabi®'s Terms of Use and Privacy Policy for additional information.

 

1. The Storyworthy Community Website and Accounts: The Storyworthy Community, located at Community.Storyworthy.com, is a platform powered by Mighty Networks. It enables Storyworthy users to connect, communicate, share experiences, and participate in an online community of storytellers. By creating an account or engaging in the Community, you agree to abide by the Mighty Networks Terms of Use, Privacy Policy, Acceptable Use Policy, Copyright Policy, and all other relevant policies outlined in the Mighty Networks Terms of Use. Please refer to the linked Mighty Networks documents for detailed information. Regarding the content you post in the Community, you retain all ownership rights, including copyrights, to the content you share. You grant a license to display the content you post in the Community.

 

10. Intellectual Property & Copyright

 

We respect the intellectual property rights of others and expect the same in return. The Agreement does not transfer any Storyworthy or third-party intellectual property to you. All rights, title, and interest in and to such property remain solely with Storyworthy. Storyworthy, Storyworthy Academy, Storyworthy Community, and all other trademarks, service marks, graphics, and logos used in connection with our websites or Services are trademarks or registered trademarks of Storyworthy (or Storyworthy’s licensors). Any other trademarks, service marks, graphics, and logos used in connection with our Services may be the trademarks of other third parties. Utilizing our Services does not grant you any right or license to reproduce or otherwise use any Storyworthy or third-party trademarks.

 

11. Changes

We may update, modify, or discontinue any aspect of our Services at any time. As we frequently update our Services, we may also adjust the legal terms under which they are provided. The Agreement can only be altered by a written amendment signed by an authorized executive of Storyworthy or by the posting of a revised version by Storyworthy. We will notify you of any changes by posting them here and updating the "Last Updated" date. Additionally, we may announce changes through our blog, email, or other communication channels before they take effect. Your continued use of our Services after the new terms become effective signifies your acceptance of the updated terms. If you disagree with the changes, you should discontinue using our Services. If you have an existing subscription, you may be eligible for a refund according to our refund policy.

 

12. Termination

 

We reserve the right to terminate your access to all or part of our Services at any time, with or without cause, and with or without prior notice. We may, at our sole discretion, reclaim your username due to prolonged inactivity, remove any content that violates the Agreement or our policies, or ask you to adjust your activities if they excessively burden our systems. We may also terminate or deny access to our Services to any individual or entity for any reason. In the event of termination, we are not obligated to provide a refund of any fees previously paid.

 

13. Disclaimers

Our Services are provided "as is," and Storyworthy and its suppliers and licensors disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be error-free or that access will be continuous or uninterrupted. You understand that you use our Services at your own discretion and risk.

 

14. Educational and Informational Use

Our Services are intended for personal, educational, and informational purposes only. Any information provided through our Services should not be construed as financial, legal, tax, medical, or any other professional advice.

 

15. Jurisdiction and Applicable Law

Unless otherwise provided by applicable law, the Agreement and any access to or use of our Services shall be governed by the laws of the State of Washington, U.S.A., excluding its conflict of law provisions. Any disputes arising out of or related to the Agreement or your use of our Services, which are not subject to arbitration as indicated below, shall be resolved in the state and federal courts located in Clark County, Washington.

 

16. Arbitration Agreement

Except for claims regarding injunctive or equitable relief or claims concerning intellectual property rights, which may be pursued in any competent court without the need for a bond, any dispute arising under the Agreement shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Vancouver, Washington, conducted in English, and the arbitral decision may be enforced in any court. The prevailing party in any action or proceeding to enforce the Agreement shall be entitled to reasonable attorneys’ fees, costs, and expenses in addition to any other relief granted.

 

17. Limitation of Liability

In no event shall Storyworthy, its suppliers, partners, or licensors be liable under any legal theory for any special, incidental, or consequential damages, including the cost of procurement for substitute products or services, or for interruption of use or loss or corruption of data. Storyworthy shall have no liability for any failure or delay due to matters beyond its reasonable control. To the extent permitted by applicable law, the foregoing limitations shall apply even if Storyworthy has been advised of the possibility of such damages.

 

18. Indemnification

You agree to indemnify and hold harmless Storyworthy, its contractors, licensors, and their respective directors, officers, employees, and agents from and against any and all losses, liabilities, demands, damages, costs, claims, and expenses, including attorneys’ fees, arising out of or related to your use of our Services, including any violation of the Agreement or any agreement with a third-party service provider used in connection with our Services, as well as any Content you post.

 

19. US Economic Sanctions

By using our Services, you represent and warrant that you are not located in any country or territory subject to comprehensive US sanctions and that you are not listed on any United States list of prohibited or restricted parties. You also agree not to use our Services in any manner that may cause Storyworthy to violate US export controls and sanctions. Storyworthy reserves the right to restrict or block your access to our Services and terminate the Agreement if it determines, at its sole discretion, that such access may violate export controls or sanctions.

 

20. Translation

These Terms were originally composed in English (US). We may translate them into other languages for convenience. In the event of a conflict between the translated version and the English version, the English version shall prevail.

 

21. Miscellaneous

The Agreement, together with any additional terms applicable to specific Services, constitutes the entire agreement between Storyworthy and you regarding our Services. If any part of the Agreement is found to be unlawful, void, or unenforceable, that part shall be deemed severable from the Agreement and shall not affect the validity or enforceability of the remaining provisions. A waiver by either party of any term or condition of the Agreement or any breach thereof, in any one instance, shall not waive such term or condition or any subsequent breach thereof. Storyworthy may assign its rights under the Agreement without restriction. You may only assign your rights under the Agreement with the prior written consent of Storyworthy.
